A Moncton judge fined a man $600 yesterday after hearing the man was driving on the highway while watching a DVD player that was sitting on his dashboard.

Paul S. Brandon, 28, appeared in Moncton provincial court yesterday to stand trial on a motor vehicle infraction. Brandon was accused of violating New Brunswick's Motor Vehicle Act by driving on a highway without reasonable consideration for other people using the highway.

Prior to the start of his trial, the accused told Judge Irwin Lampert he wanted to change his plea to guilty.

Crown prosecutor Danielle Bastarache told the court Brandon was driving a pick-up truck on Highway 2 near River Glade on Aug. 31 of last year. According to the Crown, police got a call when another driver looked into the cab of the truck and could "clearly see" a TV screen on the dashboard, at eye level.

The two vehicles were heading in the same direction and the woman who called police reported the truck was drifting out of its lane at times.

"She described his driving as erratic, and he crossed over the white line," said Bastarache, adding the woman who called police followed him all the way to Moncton.

At one point she pulled even with the truck and saw the man had headphones in his ears as he watched the screen. She honked her horn at him a couple of times to get his attention and Bastarache said he was startled because he hadn't noticed her alongside of him.

Police responded to the woman's call and pulled the man over in the Moncton area, at which time the DVD player was closed and he denied watching TV.

While Brandon admitted he was driving without consideration for others, he maintained his version of events, saying he wasn't watching a movie. He said his portable DVD player is equipped to play CDs and he was listening to music.

"She probably saw the screen up while I was switching a disc," he told the judge.

Lampert warned the man he shouldn't drive while distracted because it creates danger on the highway. He ordered the minimum fine of $600 and gave him only until the end of this month to pay, or else spend 10 days in jail.

In making his decision, the judge noted Brandon has a long list of infractions on his driving record.

Nice... Just nice. What can I say. You know, after pondering that TV screen on the dashboard I thought well at least he wasn't talking on his cell phone at the same time... was he? Anyway I feel that both of these issues are of a great concerns to those doing it as well as for potential victims of this kind of behavior. The biggest question I have had for the last 15 minutes has been: "Which is safer? or should I rephrase it, which is more suicidal: The cell phone, or the TV? It would seem that we do not need to spend a whole lot of driving concentration by glancing occasionally at a screen, as much as having to talk to someone on the phone. What do you think? One is a one-way form of entertainment and the other is a two-way form of activity needing our full attention. Which is better? You tell me. Will we soon have an added storage space in the dashboard when we are required to remove our car radios? After all they were banned at one point many moons ago.

Then throw in navigation systems or whatever other invention that comes along to further distract senseless drivers

What amazes me is the patience Judge Lambert has with cases like this!! The guy has a list of infractions and he only gets the minimum? Send a message Judge, whack these perpetual offenders with the maximum fines PLUS suspend this guy from exercising his driving privilege for a meaningful time period!! In fact, a suspension should have been automatic in this case as well as the financial levy.

Driving was made to be 100% concetration on the road,now,doesn't matter if it's a cell, a DVD,a GPS or whatever else in gimmicks they got.With the volume of traffic today on our hwy's people need to be fully aware of what's around them at all times,and with most of these mind boggling gimmicks that you have to play with different screens or buttons to find what your looking for at 120kph,doesn't make sense.Mr Harper has a bunch of thumbs down,why ?, he has a valid point.Why would they suspend him for watching t.v if he was,I think that a 600.00 fine is appropriate,he wasn't drunk,only distracted.Imagine if you were suspended each time you are distracted and swerve a bit in the road,we all do it at 1point in time.Why don't they attack young drivers who had a licence for a whole 1 yr with sound systems worth 5 times the car they drive,you hear them coming a mile away,now how safe is that when you can't hear yourself think and driving 140kph ?

I can quote that as a hwy trucker I see so much more of what goes on on the hwy compared to regular working people who barely do 200kms a week and pretty much using a regular route.I average just under 4000kms per week and I can say that many people watch t.v,playing with their GPS and going over the white line,on the phone with a coffee in the other hand holding the wheel with their knee,etc etc etc...If they want people to be safe on the road they need to limit the gadgets they allow in cars.

Driving while distracted is dangerous, plain and simple.

Driving requires your full concentration; both hands on the wheel and being aware of everything that is going on around you. Anything less and you are a danger to yourself and others around you.

The fact that the idiot in question has a long list of driving infractions shows that he is incapable of learning from his mistakes and should have his driving privileges revoked for the safety of others.

A.Harper. A navigation system is a little different then a friggin DVD player...he was watching while driving on the highway putting other peoples lives at risk. A movie would capture more of his attention then a navigation system.!

nah, all jokes aside, cell phones are bad enough, but a DVD? That is pushing it just a little.

why was these woman follow the guy in the first place! she could of made him cause an accident of something by driving beside his truck! she should be charged as well too!

Dvd player, cell phone oh and thats what the lady was on when she called to report him.... hmmmmmmm One is just as bad as the other. The cell would also require her to use only 1 hand... I am not saying one is better than the other but when she called into report him was she not breaking teh law also?
